1. Agreement to Terms

Welcome to Jasni. These Terms of Service ("Terms") govern your access to and use of Jasni's email API platform, including our website, APIs, SDKs, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Jasni provides an email API platform designed for AI agents and automated systems. Our Service enables you to:

• Create and manage email inboxes programmatically
• Send and receive emails through our API
• Process email content with AI and automated systems
• Configure webhooks for real-time email notifications
• Use custom domains for email addresses
• Integrate with AI tools through MCP (Model Context Protocol)

3. Account Registration

To use the Service, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password and API keys secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to use the Service. By using Jasni, you represent that you meet this age requirement.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service to:

• Send spam, unsolicited commercial emails, or bulk emails that violate applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
• Send phishing emails or emails intended to defraud, deceive, or harm recipients
• Distribute malware, viruses, or other malicious code
• Harass, abuse, or threaten others or violate the rights of third parties
• Impersonate any person or entity or misrepresent your affiliation
• Violate any applicable local, state, national, or international law
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Collect or store personal data about other users without their consent
• Use the Service for any illegal, harmful, or unethical purposes

5. API Usage and Rate Limits

Your use of the Jasni API is subject to the following conditions:

• API rate limits vary by subscription plan and are enforced automatically
• You must not attempt to circumvent rate limits or abuse the API
• API keys must be kept confidential and not shared publicly
• You are responsible for securing your API keys; compromised keys should be rotated immediately
• We reserve the right to throttle or suspend access for excessive or abusive usage

6. Subscription Plans and Billing

6.1 Free and Paid Plans

We offer both free and paid subscription plans. Free plans have limited features and usage quotas. Paid plans offer additional features, higher limits, and priority support as described on our pricing page.

6.2 Payment Terms

For paid plans:

• All fees are charged in advance on a monthly or annual basis
• Payments are processed securely through Stripe
• Prices are subject to change with 30 days' notice
• You are responsible for all applicable taxes

6.3 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, your account will remain active until the end of your current billing period. We do not provide refunds for partial months or unused features, except where required by law.

7. Intellectual Property

7.1 Our Rights

The Service and its original content, features, and functionality are owned by Jasni, Inc. and are protected by international copyright, trademark, patent, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit through the Service, including email content. By using the Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service to you.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you agree to the collection and use of information as described in our Privacy Policy.

9. Service Availability and Support

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted or error-free operation. We may:

• Perform scheduled maintenance with advance notice when possible
• Make changes to the Service to improve functionality or security
• Temporarily suspend the Service for emergency maintenance or repairs

Support is provided according to your subscription plan. Enterprise customers receive priority support and dedicated account management.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM

11. Indemnification

You agree to indemnify, defend, and hold harmless Jasni, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Engaging in fraudulent or illegal activities
• Non-payment of applicable fees
• At our sole discretion for any reason

Upon termination, your right to use the Service will immediately cease. We will retain your data for 30 days to allow for data export, after which it may be permanently deleted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jasni regarding the Service and supersede all prior agreements and understandings.
